I don’t know that McGahn has criminal culpability/exposure such that he can (legitimately) plead the 5th. Recall, McGahn refused to commit the crimes Trump asked him to commit. But if he invokes the 5th, Congress can extinguish (or “trump”) it by granting him immunity.
